In checking the box below I agree: In consideration of and as inducement to enrolling as a student of Steamtown Yoga LLC, Steamtown Hot Yoga, I represent and agree as follows: 1) I have been examined by a licensed physician within the past six months and have been found by such physician to be in good physical health and fully able to perform all yoga exercises which I am to learn and perform during my enrollment. 2) I will faithfully follow all instructions given to me by your instructors as to when, where and how to perform and not to perform yoga exercises, it being understood that any deviation by me from such instructions shall be at my own risk. 3) I will not assert any claim, demand, complaint or sue Steamtown Yoga, LLC, or any of its agents, employees, or officers (“Released Parties”) for any injury, death or other damages resulting from any negligence, recklessness or willful actions by any of the Released Parties occurring in the course of my attendance at and participation in class offerings at Steamtown Yoga, LLC. I hereby release the Released Parties from all actions, claims, demands and complaints that I have or may hereafter have for injury, death or other damages resulting from attendance at and use of the facilities provided by Steamtown Yoga, LLC. Furthermore, I hereby undertake to defend, indemnify and hold harmless the Released Parties and each of them from any loss, liability, damage or expense that any of them may incur as a result of my attendance at and participation in all class offerings and programs at Steamtown Yoga, LLC. I will not hold you, your partners, instructors or employees responsible for any injuries suffered by me caused in whole or in part by my failure to faithfully follow the instructions of you or your instructors or by any physical impairment of mine. 4) I understand and acknowledge that I am to receive instruction in yoga theory and exercises only and I will not hold you, your partners, instructors or employees to any higher standard of care than yoga theory and exercises. 5) The tuition paid herewith and such registration fees paid hereafter are non-refundable and non-transferable; such refunds if any shall be made entirely within the discretion of Steamtown Yoga, LLC. 6) Policies: All class passes and memberships are not transferable, non-refundable and cannot be frozen. Please respect our policies. We accept cash, Visa, MasterCard, Discover and Checks. We cannot accept credit purchases for under $10. 7) Students under 18 must have an adult accompany them to the studio for their first class and are admitted at the discretion of Steamtown Yoga 8) We are not responsible for your valuables or belongings. In consideration of my use of the facilities provided by Steamtown Yoga LLC hereafter referred to as “the company” “company”, I expressly agree and contract, on behalf of myself, my heirs, executors, administrators, successors and assigns, that the company and its insurers, employees, officers, directors, and associates, shall not be liable for any damages arising from personal injuries (including death) sustained by me, or my guest in, on, or about the premises, or as a result of the use of the equipment or facilities, regardless of whether such injuries result, in whole or in part, from the negligence of the company. By the execution of this agreement, I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which may occur to me or my guest, and I hereby fully and forever release and discharge the company, its insurers, employees, officers, directors, and associates, from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out the use of said equipment and facilities. I expressly agree to indemnify and hold the company harmless against any and all claims, demands, damages, rights of action, or causes of action, of any person or entity, that may arise from injuries or damages sustained by me or my guest. I agree to be solely responsible for safety and well being of my guest and myself. I understand that the company does not provide supervision, instruction, or assistance for the use of the facilities and equipment. I agree to comply with all rules imposed by the company regarding the use of the facilities and equipment. I agree to conduct myself in a controlled and reasonable manner at all times, and to refrain from using any equipment in a manner inconsistent with its intended design and purpose. I understand and acknowledge that the use of any equipment involves risk of serious injury, including permanent disability and death. I understand and agree that the company is not responsible for property that is lost, stolen, or damaged while in, on, or about the premises. I understand and agree that my use of the facilities and equipment is only to be undertaken on my own personal time, and that my use of the facilities and equipment is not within the course or scope of my employment. By registering for and voluntarily participating in Steamtown Yoga, LLC’s classes and services, I do so with full knowledge of the inherent risks associated with yoga practice and any related activity, and accept the risks of injury, death and other damages arising from my participation. I will not assert any claim, demand, complaint or sue Steamtown Yoga, LLC, or any of its agents, employees, or officers (“Released Parties”) for any injury, death or other damages resulting from any negligence, recklessness or willful actions by any of the Released Parties occurring in the course of my attendance at and participation in classes and services. I hereby release the Released Parties from all actions, claims, demands and complaints that I have or may hereafter have for injury, death or other damages resulting from attendance at and use of the facilities provided by Steamtown Yoga, LLC during classes and services. Furthermore, I hereby undertake to defend, indemnify and hold harmless the Released Parties and each of them from any loss, liability, damage or expense that any of them may incur as a result of my attendance at and participation in classes and services. By registering for and voluntarily participating in Steamtown Yoga, LLC’s offerings, I consent to the use of my image in Steamtown Yoga, LLC editorial and promotional materials in any manner and any media throughout the world in perpetuity, and all resulting intellectual property shall be the sole property of Steamtown Yoga, LLC. I additionally hereby allow my image from participation to be edited at the sole discretion of Steamtown Yoga, LLC, and I hereby expressly release the above-defined Released Parties and any of their licensees and assignees from and against any claims, demands and actions I may have or may hereafter have for invasion of privacy, defamation, or any other cause of action whatsoever arising out of the production, distribution, broadcast, exhibition or other forms of communication used by Steamtown Yoga, LLC. I HAVE READ THE FOREGOING WAIVER AND RELEASE OF LIABILITY AND VOLUNTARILY EXECUTED THIS DOCUMENT WITH FULL KNOWLEDGE OF ITS CONTENT.
